ATE insurance is unusual compared to standard insurance policies in that it provides cover for an event that has already occurred. Standard insurance will look to automatically exclude disputes already know and pre-existing sets of circumstances or incidents which have occurred prior to application. ATE is a type of legal expenses cover, so it covers costs exposures. It is traditionally purchased by claimants, and the core cover is for adverse costs awards.

This highly specialised insurance policy is a rarity in Australia, with very few being accepted by Australian courts.  With the assistance of underwriters in London, Delphic Insurance Services has been able to offer cover in the past which have been successfully enforced.
